Guidelines for Investment in Advertising Industry by Foreigner

The establishment of foreign investment, mergers and acquisitions of advertising enterprise, in addition that it must comply with "Regulations on Administration of Foreign-invested Advertising” and  the "State Administration for Industry and Commerce, Ministry of Commerce, Foreign Investors held through Equity Acquisitions of Foreign-invested Advertising Enterprise-related Issue Notice", it should also comply with the "Foreign Equity Joint Ventures Law", the "People's Republic of China JV Law", the "PRC Foreign Enterprise Law ", the "PRC Advertising law", the "Advertising Regulations" and the other relevant laws, regulations and regulations.

In order to promote Hong Kong, Macau and the Mainland to establish closer economic relations, to encourage Hong Kong service providers and Macau service suppliers to establish advertising enterprises in Mainland, according to the State Council which approved the "Mainland and Hong Kong Closer Economic Partnership Arrangement", the "Mainland and Macau closer Economic Partnership Arrangement" , it is now, in supplement to the Hong Kong and Macau investors to the advertising industry that, it provides the followings:-

Firstly, Since 1 January 2004 onwards, it allows Hong Kong service providers and Macau service providers to establish in the Mainland a wholly-owned advertising company.

Secondly, Hong Kong and Macau service providers shall conform to the "Mainland and Hong Kong Closer Economic Partnership Arrangement Row” and the "Mainland and Macau Closer Economic Partnership Arrangement", in which, the word "Service Provider "is defined in its related provisions and requirements.

Thirdly, Hong Kong service providers and Macau service suppliers should be operating (including non-core) as an advertising business entity.

Fourth, For Hong Kong and Macau service providers providing investment in Mainland, other provisions for implementation of advertising industry shall be in accordance with the "Foreign-invested Advertising Enterprise Management regulations”.
